Product liability is something that has been in the news lately. There are different types of liability:
1. Manufacturing defects
2. Design defects
3. A failure to warn or a marketing defect
These things in most states are not legal claims in and of themselves. They are pleaded in terms of theories.
Like most people, I’ve owned defective products. The problem was that again like most people, I just let it go. I didn’t worry about legal counsel or complaining to the company. I just didn’t buy anything from that company again. I have also returned items and the store that I purchased it from replaced the defective product.
The Toyota recall seems to be a different deal altogether. This is a situation where, in my opinion, the manufacture ignored the problem. They seemed to be aware but didn’t address the issue. They also still seem to be ignoring the issue. This to me is a case where a Product Liability Lawyer could be of benefit.
